Recently, the Levine Act took effect, preventing CSD controllers like Kevin Loewen from accepting over $250 related to a government contract. However, it's now known that Kevin was working for DTA, which had a contract with his CSD. Could this be the reason that Kevin, Noelle, and the others refused to sign the County-required verifications of DTA's work, opting for a costly lawsuit with Joe Harn?
The CSD's new attorney will be addressing the CSD's Levine Act compliance at tonight's meeting (see pic)
Guess who raised the issue about the CSD's lack of compliance. I digress...

๐ A 2020 California Court of Appeal decision in Fowler v. City of Lafayette (2020) determined that Government Code section 54956.9, subdivision (e)(5), mandates the District to share the litigation threat with the public in the meeting agenda packet. On Feb 20, 2024, I exposed to EDC's DA an illegal agreement from Aug 4, 2020, where the County, the Developer, and the District 'gifted' millions in public funds for Village J Park, violating the CA Constitution (Art. XVI, ยง 6). Auditor-Controller Joe Harn confirmed $7,059,872 was available for park acquisition and construction ๐ข๐ง ๐๐ง ๐๐ฆ๐๐ข๐ฅ ๐ญ๐ก๐๐ญ ๐ข๐ง๐๐ฅ๐ฎ๐๐๐ ๐ญ๐ก๐ ๐๐๐, ๐๐จ๐ฎ๐ง๐ญ๐ฒ ๐๐ง๐ ๐ญ๐ก๐ ๐๐๐ฏ๐๐ฅ๐จ๐ฉ๐๐ซ (see pic) yet the County and CSD relieved the developer of this obligation.
This misuse of public funds must be corrected. I'll let you all know now many more community members need to file a formal complaint to get this resolved! But, it must be corrected. ๐ฃ๏ธ

One more example of the collusion and complete disregard of how this county spends our tax dollars. This is one more reason that the BoS, needs their own staff (not county counsel, general staff or the CAO, and frankly some of the elected's) to insure that the BoS actually understand what's happening and how they are spending our money. How can I help?

๐จ EDHCSDโs 2024-25 BUDGET DIDN'T GET RUBBERSTAMPED! ๐จ
Despite extensive presentations by CSD'S staff, concerns raised public comments made at this and previous meetings made the board hit pause. Hereโs whatโs got them thinking twice:
๐ The LLAD Engineerโs report needs a total overhaul. ๐๏ธ (Now tabled twice)
๐ผ The 2024-25 budget hinges partly on this report. (Now tabled once)
๐ Plus, our outside auditorโs 2023 annual audit is 6 months overdue, with unanswered questions lingering.
Stay tuned for updates as the CSD's staff work through these issues.
Next meeting pertaining to all of the above is scheduled for June 13, 2024.
